Terms and Conditions

All transactions between Aeroplans Blaus and the Customer are subject to the following General Conditions:

Prices. The prices indicated in our online store (http://aeroplans-blaus.com) do not include Value Added Tax (VAT) or any other tax, duty, or fee, nor shipping costs, which will be charged to the invoice at the applicable rate at the time of sale and are subject to change without prior notice. Published prices are valid except for typographical errors.

Graphic Media. The photographs, graphics, drawings, and illustrations of the products are for informational purposes only and have no contractual value.

Availability. Our online store displays the availability of each product; this information is for guidance only and does not constitute any obligation on our part. To ensure the availability of a product prior to purchase, please contact us. If, due to an inventory error, a product appears in stock when it is not, the Customer may choose to wait until the product is in stock (the approximate time will be informed) or request a refund of the payment made.

Minors. We do not sell products to minors. The products we sell must be purchased by adults. Minors under 18 years of age may only use Aeroplans Blaus services under the supervision of a parent or guardian.

Payments. Payment for orders will be made by bank transfer, credit card, PayPal, Bizum, or Nacex cash on delivery, at the Customer's choice, and on the date prior to or equal to the agreed due date. In the event of non-compliance, Aeroplans Blaus reserves the right to suspend any current order, charge the Customer any bank charges incurred due to non-payment, and immediately initiate any legal action it deems appropriate to recover the debt, with the Customer assuming any resulting costs. Payments by credit card, PayPal, or Bizum are considered completed after approval by the computer system using SSL encryption and entering data on a secure page. Both the Customer and Aeroplans Blaus are notified immediately. In the case of bank transfers, payment is considered completed when the amount is received in the Aeroplans Blaus account. No documents or emails are accepted as proof of payment.
For cash-on-delivery shipments, the Customer must pay NACEX a refund fee of 3% + VAT of the refund value, with a minimum of €3 + VAT and a maximum of €30 + VAT. The maximum refund amount is €1,000, VAT included.
For payments made through the PayPal system, a fee of €0.35 + 3.4% of the order value applies.

Retention of Title. The goods are supplied under retention of title to Aeroplans Blaus until full payment obligations are met and may be withdrawn in the event of non-compliance by the agreed deadline.

Deliveries. Delivery to the Customer will be deemed complete when Aeroplans Blaus makes the purchased goods available to the carrier. It is the Customer's responsibility to inspect the products upon receipt and state any justified reservations and claims on the delivery note.
If delivery is made to Aeroplans Blaus facilities, it is deemed complete once payment has been formalized and the corresponding invoice has been delivered or the delivery note has been signed.

Shipping. Goods travel at the buyer's expense and risk, regardless of the shipping company responsible for delivery. The various shipping options offered by Aeroplans Blaus (Nacex and UPS) only include the minimum mandatory insurance according to the Transport Regulation Law. In the event of any incident during the delivery process (theft, loss, damage, breakage, etc.), you will be entitled to compensation according to the general terms and conditions of the selected shipping company.
Shipping costs are automatically calculated when placing the order online based on the weight, carrier, and delivery location.
International orders or orders destined for the Canary Islands, Ceuta, and Melilla do not include customs fees or taxes that may be applicable at the delivery location, which must be paid in full by the Customer at the destination to the requesting authorities.
The Customer may send any other shipping company or person to collect the purchased goods, with prior notice and during our business hours.
If the material is not in stock, the customer will be informed of the delivery time. Orders are accepted, but no shipments are made when the company is closed for vacation. Holiday periods are displayed on the main page of our online store.
Orders are not shipped until payment has been received, except for refunds.

Returns. Returns of purchased items are accepted within 15 business days of the delivery date. Returned items must be returned in the same condition as purchased, along with the original packaging and documentation. Return shipping costs are the customer's responsibility, except in the case of obvious errors on the part of Aeroplans Blaus in the preparation of the shipment. Payment for the return will be made in the same manner as payment was made. Returns for Special Orders are not accepted.

Special Orders. Special orders are those consisting of products that Aeroplans Blaus requests from its suppliers at the customer's express request. The customer will be informed of the amount due to formalize the order and the estimated delivery time. The order will be processed once this amount has been received. The customer may claim a refund of the down payment if the order has not been delivered by the end of the estimated delivery time plus 4 weeks, excluding holiday periods. Once the customer has been informed of the receipt of their special order, they have 2 months to complete the payment and collect the order. If payment has not been completed within this period, the customer expressly waives both their order and the down payment made.

Disclaimer of Liability. The products supplied by Aeroplans Blaus will be used exclusively for the purposes specified by the respective manufacturer. The customer will be solely responsible for any consequences that may arise from the use of the supplied products, at their own risk and expense.

Claims for damages made by the customer for any reason without gross negligence or intent are expressly excluded.

Warranty. Products purchased from Aeroplans Blaus have a minimum warranty of two years from the date of purchase, except for those for which a different period is specified or which are considered consumables (batteries, windsocks, parachutes, fire extinguishers, etc.). The warranty details for each product are provided by the manufacturer in each case. The purchase invoice is the warranty document.

Repairs. If equipment needs to be repaired, whether purchased from us or not, and regardless of whether the equipment is under warranty, the customer has two options: Send it directly to the manufacturer's official technical service center or send it to Aeroplans Blaus for paid repair. In either case, the customer will be responsible for all costs incurred by the repair (shipping, spare parts, labor, etc.). It is up to the official technical service center to decide what is covered by the warranty and what is not.

Storage and Disclaimer. After 90 days from the Customer's notification to collect their goods, a storage and conservation fee of €1.00 + VAT per deposited item will be charged for each day in excess. The owner of the material will be deemed to have relinquished possession of it due to abandonment (Article 460 of the Civil Code) if it is not collected within one year of its arrival at the workshop (Article 1968/1 of the Civil Code). Furthermore, the Technical Service will retain the material until payment has been made for the repair cost and any storage and conservation costs (Article 1600 of the Civil Code).

Data Protection. The Client consents to the processing of their personal data for the exclusive commercial purposes of Aeroplans Blaus and arising from their business relationship in accordance with Organic Law 15/1999 and other applicable regulations, without transferring such data to other persons or companies. If the Client declines to receive offers from Aeroplans Blaus, or wishes to access, rectify, or delete their data, they may do so in writing to: Aeroplans Blaus, Ap. Correos nº4, 08440 – Cardedeu, clearly specifying their details along with a copy of their Tax Identification Number (NIF) or National Identity Document (DNI).

Litigation. The parties expressly waive any other jurisdiction that may apply to them and submit to the jurisdiction and competence of the Courts and Tribunals of Granollers for the resolution of any dispute that may arise from the interpretation, application, compliance, etc., of this contract.
